Title 8 - Declining Juvenile Court Jurisdiction Over An Alleged Juvenile Offender

JuCR 8.1: TIME FOR DECLINE HEARING

(a) Initiating Decline Hearing.

If required or requested pursuant to RCW 13.40.110, a decline hearing shall be scheduled and held separate from and prior to the adjudicatory hearing.

(b) Time for Hearing in Felony Cases.

In any case where declining jurisdiction would allow criminal prosecution for a felony, the decline hearing shall be held within 14 days after the information is filed unless the time is extended by the court for good cause.

(c) Notice.

Notice of the decline hearing and its purpose shall be given in accordance with rule 11.2.

JuCR 8.2: PROCEDURE AT DECLINE HEARING

The decline hearing shall be conducted in accordance with RCW 13.40.110(2). Any report or study to be presented to the court must be made available to the opposing party for a reasonable period prior to the hearing or reasonable time must be accorded the opposing party to respond.
